Terms of use


I (hereinafter referred to as the "User"), agree to the terms of this User Agreement and, by using the website bactosfera.ua (hereinafter referred to as the "Website") during registration, ordering, correspondence, telephone conversation, leaving reviews and comments, etc., consent to the processing of my personal data (hereinafter referred to as "Personal Data") within the framework of the Law of Ukraine "On the Protection of Personal Data", in accordance with the terms set forth below.

1. Owner of Personal Data and Website Owner

1.1. LLC "BACTOSFERA" (BACTOSFERA LLC), identification code: 39621673, address: Ukraine, 03151, Kyiv city, Svyatoslav Khorobroho Street 1 (hereinafter referred to as the "Owner" and/or "Seller") is the owner of the Users' Personal Data and the owner of the Website.

2. Composition and Content of Personal Data

2.1. The User's Personal Data is any information that directly or indirectly relates to the User. This may include: name, surname, patronymic, phone number, email address, language of communication, delivery address, information about the User's actions while using the Website, IP address, data about devices used by the User (device type, browser type, device operating system), message history, information contained in correspondence between the User and the Seller, review or comment history, other information used for communication, and information voluntarily provided by the User in the registration form and/or when filling out their profile on the Website, information obtained during oral and/or telephone communication between the User and the Seller, information provided when making a payment on the Website. This list of personal data is not fixed and mandatory for all Users but depends on the needs and desires of the User and the operations they perform on the Website. Personal Data may also include information obtained by the Website legally from third parties.

2.2. Users are responsible for all information they post in public accounts and are aware of all the risks associated with it.

3. Purpose, Scope, and Duration of Personal Data Processing

3.1. The purpose of processing Personal Data is to ensure the implementation of civil-legal relations, economic, tax relations, fulfillment of the functions, powers, and duties imposed on the Owner in accordance with the current legislation of Ukraine, identification of the client as a User of the Website, for communication with the User including for the provision of services, processing payments, sending orders, conducting settlement operations, providing reporting, maintaining accounting and management records, sending information by mail, email, and phone.

3.2. The processing of Personal Data is limited to collecting the minimum amount of mandatory information necessary solely to fulfill the User's request. In any case, when non-mandatory information is requested, the User is informed at the time of collection of such information. Non-mandatory information is provided by the User at their own will and discretion.

3.3. The periods of processing and storage of Personal Data are determined based on the purposes of data processing, as well as the terms specified in the contracts concluded with the User in accordance with the requirements of the current legislation of Ukraine. Personal Data is processed and stored as long as necessary to achieve the purposes for which it was collected, including to comply with any legal, accounting, or reporting requirements or until the data is deleted by the User or upon the User's request.

3.4. The Website may contain links to other websites (for informational purposes only). When navigating to other websites, this Agreement does not apply to such sites.

3.5. Users can at any time change/delete personal information, or unsubscribe from mailing lists, or obtain any information regarding their Personal Data held by the Owner, or withdraw consent for the processing of Personal Data. This can be done by sending a message to the email address info@bactosfera.ua with the subject "Personal Data".

4. Location and Protection of Personal Data

4.1. The Personal Data of the Website Users is located, processed, and protected on the Owner's servers.

5. Conditions for Disclosing Personal Data to Third Parties

5.1. When the User orders goods and/or services on the Website, Personal Data is disclosed to the extent necessary to identify the User, fulfill and process the User's order (including for shipping and delivery of goods, making payments for goods/services, etc.).

5.2. The Owner has the right to grant access to and transfer Personal Data to third parties without any additional notifications, without changing the purpose of their processing as defined in this Agreement.

5.3. In cases of transfer of Personal Data, provided for in this section, informing the User about the transfer of their Personal Data remains at the discretion of the Owner.

6. Prices and Availability of Goods

6.1. The description of goods posted on the Website, including prices and information about the availability of goods, may change. The order amount may vary depending on the price, quantity, and assortment of goods available on the date of shipment. The final cost of the goods is indicated in the settlement and/or accompanying documents provided to the User (or their representative) upon receipt of the order.

6.2. In case of the absence of goods, the Seller may unilaterally cancel the order.

7. Cookies

7.1. The process of collecting Personal Data on the Website occurs using "cookies" technology. Cookies are pieces of information that the Website transfers to the User's hard drive to store information related to the Website. This technology expands the use of the internet by storing the User's preferences while browsing the Website. Cookies technology does not contain personal information and cannot configure the User's device system or read information from their hard drive.

7.2. During the browsing of the Website, cookies may be placed on the User's computer. These temporary cookies are used to count the number of visits to the Website. They are deleted when the User exits the browser. Persistent cookies can only be stored on the User's computer by their browser. Cookies do not contain Personal Data and can be blocked by the User at any time. Cookies do not receive personal information about the User, do not collect their contact information, nor do they obtain any information from the computer.

7.3. Cookies allow the User to fully utilize all the capabilities of the Website, so it is recommended to leave them enabled.

8. Public Offer

8.1. The offer on the Website is not an offer. After reviewing the posted offer, the User has the right to make an offer to the Seller by filling out the order form through the Website and/or placing an order by phone at the numbers indicated on the Website. Filling out the order form is considered an offer by the User to the Seller to purchase the goods on the terms specified in the corresponding offer.

8.2. The offer is considered accepted by the Seller if the Seller has performed actions indicating acceptance of the User's offer, namely: actually shipped the goods, commenced providing services in accordance with the terms specified in the User's offer, or issued an invoice for the ordered goods.

8.3. Information about the product displayed on the Website is dynamic. This means that the information can be updated, changed, and supplemented by the Owner at any time without prior notice to the User. The current information about the products and services of the Seller is displayed on the Website.

8.4. The Seller has the right to offer to sell the goods on other terms after receiving the User's offer. In such a case, this proposal is considered a counter-offer and must be accepted by the User. Acceptance of the counter-offer is considered the actual receipt of the goods by the User on the terms specified in the counter-offer. The Seller has the right to withdraw the counter-offer before the User receives the goods.

8.5. Agreement on all significant terms between the User and the Seller is the payment and/or actual receipt of the goods by the User, as well as the shipment of goods by the Seller.

8.6. The Seller's liability for changing the terms of sale of goods is limited to the User's right to refuse to purchase the goods and demand a refund of the paid funds (if paid).

8.7. Product photos are provided for reference purposes, the description of the product on the Website may differ from the purchased product.

8.8. The characteristics and configuration of the product may be changed by the manufacturer without prior notice. The Seller is not responsible for changes made by the manufacturer of the product. The actual technical characteristics of the product are provided in the accompanying documents for the product.

8.9. Exchange or return of goods is possible within 14 days from the date of purchase in accordance with the Law of Ukraine "On Consumer Rights Protection". Goods subject to exchange/return must not have been used, must be working and undamaged, with preserved marketable appearance, configuration, and purchase document. Possible transportation costs associated with the exchange/return of goods are borne by the User.

9. Amendments to the Agreement

9.1. The Owner may periodically unilaterally update this Agreement without notifying the User of such changes. The new version of the Agreement comes into force from the moment it is posted on the Website, unless otherwise provided by the new version of the Agreement.

9.2. If any changes are made to the Agreement that the User does not agree with, they must stop using the Website. The fact of continuing to use the Website confirms the User's agreement and acceptance of the respective version of the Agreement.
